The common council, or City Council, is
both the legislative and the fiscal body. Every four years, residents of the City of Peru elect seven members to serve as the Common Council. The Council consists of one part-time member from each of five districts plus two "at large" members. A member is not subject to term limits and may run for re-election as often as they wish. A Council member must have been a resident of the district from which he or she is elected for at least six months before the election, and a resident of the city for at least one year. The Common Council may pass ordinances, orders, motions and resolutions for the government of the City of Peru, the control of the city's property and finances and the appropriation of money.

The Common Council of the City of Peru, Indiana met in a regular session in City Hall at 6:00 pm. October 3, 2011 with the following members present: Terry Alley, Steve Gough, Tom Gustin, Kurt Krauskopf, Cheryl Lee, Brian Robertson and Phyllis Torrence. ORDINANCE 14, 2011

AN ORDINANCE ESTABLISHING DESIGN GUIDELINES FOR THE
DOWNTOWN PERU HISTORIC DISTRICT

WHEREAS,
the City of Peru Planning Commission received a request for an ordinance for the Downtown Historic District Design Guidelines, after a Public Notice on the 22nd of June 2011 and Public Hearing on the 12th day of July, 2011 the city of Peru has given Favorable Recommendation and therefore: submits their recommendation to the City of Peru Common Council for final action.
THEREFORE BE IT ORDAINED by the Common Council for the City of Peru, Indiana, that said attachment "A" Design Guidelines for Downtown Peru Historic District be considered and adopted.
Section 1: This Ordinance with its exhibits is hereby submitted and shall be in full force and effect from the 1st day of January, 2012 and after its passage as provided by law.

Downtown Merchants Gary Mock, Ron Droscha, Alexandria Blong, Beth Rhodes, Scott Shepherd, Miles Staley made comments to the Council, as did MCEDA Director Jim Tidd and Chamber Director Sandy Chittum.

AN ORDINANCE ESTABLISHING SALARIES AND WAGES OF THE
CIVIL CITY EMPLOYEES AND APPOINTEES FOR THE YEAR 2012

Under the Acts of 1980, P. L. 212, Section 3, I. C. 36-4-7-3 (b) and (d) and Acts 1981,

P. L. 309, Section 52, I. C. 36-8-3-3 (d), it is provided, "that subject to the approval of the City Legislative Body, the City Executive shall fix the compensation of each appointive officer, deputy and other employees of the City. The Legislative Body may reduce but may not increase any compensation fixed by the Executive. When the salary of such officers or employees shall have been so fixed as herein provided, it shall be the duty of the Legislative Body to appropriate the monies to pay the same."

This participation amount will be deposited directly to each employee’s HSA.

Smokers/Tobacco Users means employee, spouse or dependent who smoke or use any smokeless tobacco products.

All employees/family members utilizing the health insurance program will be required to submit to a urine screening upon request by Peru Board of Public Works and Safety to test for nicotine. Testing will be conducted by Patient Care Partners. Failure to comply will be considered to be a nicotine user and will pay higher rate.

Anthem Blue Cross/Blue Shield Health Insurance will be based on a 2 tier system: Single and Family. The deductibles will be $2650.00/ Single and $5250.00/ Family.
The Group Health Insurance Program is Blue Access for a Health Savings Account (HSA). The Health Savings Account will be set up under each employee’s name. This account will be the sole responsibility of the employee.
The City of Peru will contribute $1,000.00/Single, $1,500.00/Employee and One Dependent and $2,000.00/Family to each employee’s HSA.
Employees leaving the City of Peru employment will have to repay this amount at a rate of $83.00 a month/Single, $125.00 a month/ Employee and one Dependant and $167.00 a month/Family.

As per Resolution No. 2, 1992, members of the 1937 Fire Fighters Pension Fund and 1953 Police Officers Pension Fund who have completed 25 years of continuous service, the City of Peru shall pay 100% of the premium for said Public Safety Employee. However, in no event, shall the City of Peru be obligated to pay all or any portion of the premium for dependents, spouses, or surviving spouses. Unfortunately, due to extenuating circumstances, the City of Peru can no longer afford a self funded insurance plan. Therefore, we have been forced to change to a Health Saving Account for all employees and retirees. Consequently, the public safety employee will receive the same benefit as a single employee which will entitle that public safety employee to a deposit of $1,000.00 annually to their HSA.

3. City employees who use their personal vehicles for city business shall be compensated at the rate set per Federal Government.

4. Longevity Pay will be paid to each full time city employee including Firefighters and Police Officers as follows: After 1 year of service all employees to be paid ½ per cent per year of service based on employee’s base pay with increase payable each year on his/her anniversary date.

5. Overtime Pay for any hourly employee working in excess of eighty (80) hours per pay period shall be compensated at 150% of their normal hourly rate for each full hour exceeding eighty (80) hours. Police Department will also be compensated at 150% of their calculated hourly rate for each full hour exceeding eighty (80) hours.

6. All Sanitation, Motor Vehicle Highway and Traffic Department employees shall receive $300 per year Clothing Allowance; $150 to be paid on July 1st and $150 to be paid last pay in December. Employee must work 6 months before receiving full amount of Clothing Allowance benefit; less than 6 months to be pro-rated.

7. All Departments shall receive the same number of holidays as recognized on an annual basis by the Peru Board of Public Works and Safety. Each Firefighter/Police Officer will be paid $123.18 for each holiday; also, Clothing Allowance totaling $ l, 000.00 per year.

8. All full time City employees, including Firemen and Policemen, will receive three (3) Personal Days, to be taken with the authorization of Supervisor.

9. The following Specialty Areas of pay for the Police Department are:

Officer may elect additional compensation for not more than (2) Special Training Areas. Specialty Pay is payable to Officers upon successful completion and certification of each course of study. All Specialty Pay is $400.00 per individual. All specialty training must be pre-approved by the Board of Works.

11. All Full time employees will receive a $25,000.00 Life Insurance Benefit (this benefit is non-transferable.)

12. Police Shift Differential: The City will provide shift differential for those officers who are scheduled to work either a 2nd or 3rd shift. Shift differential will only be paid when the 2nd or 3rd shift is actually worked. Any time off (vacations, personal days, comp time, etc.) will not be considered for shift differential. The differential will be paid at a rate of .35 cents per hour.

OLD BUSINESS:
ORDINANCE NO. 19, 2011

AN ORDINANCE AMENDING RATES, CHARGES AND SERVICE CONDITIONS FOR THE CITY OF PERU MUNICIPAL WASTEWATER WORKS LOCATED AT THE GRISSOM AEROPLEX SERVICE AREA

WHEREAS
, the Common Council of the City of Peru, Indiana ("City") has previously adopted Ordinance 30, 2009 ("Ordinance"); establishing the sewer rates and charges for the use and services rendered by the sewage works for the Grissom Aeroplex Service Area ("Grissom Aeroplex Service Area"); and

WHEREAS, the City has caused a rate study to be completed by H.J. Umbaugh & Associates, Certified Public Accountants, LLP, Indianapolis, Indiana, and based upon such study, the Common Council of the City finds that a new rate classification for the Indiana Department of Corrections Miami Correctional Facility should be established and that the rates for current rate classifications should be reduced; and

WHEREAS, the Peru Utilities Service Board has previously reviewed the rate study and has voted to accept said study and recommend to the Common Council of the City that an ordinance be adopted implementing the rates and charges contained in said study; and

WHEREAS, this ordinance was introduced and pursuant to IC 36-9-23-26, a notice of a hearing setting forth the proposed schedule of rates and charges has been published and mailed to owners of vacant or unimproved property and mailed to the users of the Grissom Aeroplex Service Area sewage works located outside the City’s corporate boundaries; and

WHEREAS, the Common Council has held a public hearing on the 3rd day of October, 2011, at 5:30 p.m., at which users of the sewage works of the Grissom Aeroplex Service Area, owners of the property served or to be served by such works, and other interested persons have been allowed to be heard concerning the proposed rates and charges;
THEREFORE BE IT ORDAINED by the Common Council of the City of Peru, Indiana as follows:
The following rates established in Section 1 of the Ordinance are hereby amended and restated as follows:

Section 2. All other provisions of and all other rates and charges established by the Ordinance shall remain in full force and effect.
Section 3. No connection to the sewage works in the Grissom Aeroplex Area shall be allowed until sewer availability fee has been paid. Such fee shall be paid in full at the time application is made for a sewer tap permit and is non-refundable.
Section 4. There is hereby established, as of the effective date of this ordinance, a sewer availability fee for the Grissom Aeroplex Service Area. For each new connection to the Grissom sewer collection system, the Availability Fee shall be based upon the size of the water line tap connected to the water distribution system by the applying facility, as detailed below:

Availability Fees are based on a ratio of a ¾" tap, the normal size for residential installations, and the size tap used in any particular connection. For connection sizes not shown above, the cost shall be calculated using the ratio of the diameter of a ¾" tap to the diameter of the tap in any particular installation.

Section 5. A new connection to the wastewater system must also install a meter to measure water flow into the facility, even in instances in which the facility is not connected to the Peru Utilities water distribution system, and the Availability Fee assessed under this Chapter shall be determined by the size of the tap to which the meter is connected. Such meters must meet the specifications of Peru Utilities, and shall be installed at the expense of the owner or developer.

Section 6.All sewer availability fees collected from the Grissom Aeroplex Area shall be deposited into the Grissom Aeroplex Sewage Works Improvement Fund.

Section 7.This ordinance shall be in full force and effect from and after its passage and approval by the Mayor.

NEW BUSINESS:
RESOLUTION NO. 16, 2011

PERU COMMON COUNCIL, PERU, INDIANA CONFIRMATORY RESOLUTION OF THE DESIGNATION OF ECONOMIC REVITALIZATION AREA

WHEREAS, Indiana Code 6-1.1-12.1 allows for the partial abatement of property taxes for certain property constructed or located in Economic Revitalization Areas; and

WHEREAS, Indiana Code 6-1.1-12.1 empowers the Peru Common Council (hereinafter "Council") to designate Economic Revitalization Areas and determine the length of time that such designations will be valid by following a procedure involving the adoption of a declaratory resolution, provision of a public notice, conducting a public hearing and adoption of a confirmatory resolution confirming the declaratory resolution or a modified version of the declaratory resolution; and

WHEREAS, the Council desires to designate certain property as an economic revitalization area, to wit;

WHEREAS, the Council did adopt on September 6, 2011 a Declaratory Resolution for the designation of the subject property as an Economic Revitalization Areas pursuant to Resolution No. 13, 2011 of Peru Common Council with the subject property being commonly referred to as "Downtown Peru" in that Declaratory Resolution; and

WHEREAS, a copy of the Declaratory Resolution and a description of the subject property were available for public inspection in the office of the City Clerk Treasurer and the Miami County Assessor; and

WHEREAS, the council will base the length of the abatement periods for specific applicants for tax abatement within the Economic Revitalization Area on such factors as type of project, investment, effect on tax rate, new job creation or the retention of jobs; and

WHEREAS, the Council conducted a public hearing on this matter on October 3, 2011 at 5:45 p.m. and, after consideration of all comments, concludes that the legal requirements for an Economic Revitalization Area have been met and that it is in the best interest of the City of Peru that the area in question be designated an Economic Revitalization Area.

NOW, THEREFORE BE IT RESOLVED, that the previously advertised property as shown on the attached legal description and more commonly known as the site for the "Downtown Peru" is located within the jurisdiction of the Council for purposes of IC 6-1.1-12.1 et seq. and is hereby declared an Economic Revitalization Area.

This resolution shall be in full force and effect upon its passage by the City of Peru Common Council.

BE IT FINALLY RESOLVED, that if any part, parts, clauses, or portions of this Resolution shall be adjudged invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of constitutionality of this Resolution as a whole or any part, clause, or portion of this Resolution.

A PETITION TO VACATE a north/south Public Alley located between lots 61 & 62 WALLACE HGTS addition to the City of Peru more known as 38 Cory Avenue was executed by the owner of 38 Cory Avenue Peru In. 46970. After Public Notice and Public meeting on the 13th of September 2011 the City of Peru Planning Commission has given its Favorable Recommendation and therefore submits their recommendation to the City of Peru Common Council for final action.
NOW THEREFORE; BE IT ORDAINED BY THE COMMON COUNCIL FOR THE CITY OF PERU, INDIANA
SECTION 1: The following described South half of a North/South alley be and hereby vacated: located on the north side by east/west alley; on the east by Wilson Street; On the west by South Broadway and on the south by Cory Avenue. Said petitioner the owner of 38 Cory Avenue is Beverly Carriger. All existing Easements now in effect will continue in perpetuity.
SECTION 2: Said Public Alley is not necessary for the development growth to the City of Peru, Indiana. That such proposed vacation is for the public good.
SECTION 3: Public Utilities for Electric, Gas, Phone and Cable have given their approval and all easement rights to this alley remain in effect for the above.

A RESOLUTION OF THE COMMON COUNCIL OF PERU, INDIANA SUPPORTING THE FINANCIAL PLAN FOR THE RENOVATION OF THE PERU PUBLIC LIBRARY
Whereas:
The renovation of the Peru Public Library would aid in literacy and the educational development of our community; and
Whereas:
the renovation of the Peru Public Library would serve to assist in the economic development of our community; and
Whereas:
The Peru Public Library has inadequate space and problems with accessibility and maintaining outdated, inefficient systems; and
Whereas
: Renovation would provide for a more cost effective means to provide library services by becoming more energy efficient and reducing the number of staffing stations; and
Whereas:
The library would provide one third of the three million dollar cost of their plan to renovate the library from grants and other sources of funds before the project would commence; and
Whereas:
The Peru City Council has already approved the Peru Library’s plan to renovate; and
Whereas:
Over fifty percent of Library usage constitutes usage by county residents.
Now, Therefore,
be it resolved that the City Council of the City of Peru, Indiana approved the libraries plan to ask for a two million dollar bond issue contingent upon the following:
a. The Peru Public Library Board is able to provide one million dollars toward the three million dollar cost and:
b. When the Miami County Council approves assisting the Peru Public Library in retiring the two million dollar bond issue by providing $50,000/year for 20 years from CEDIT funds.

AN ORDINANCE AMENDING THE ELECTRIC RATE ORDINANCE TO PROMOTE SMALL, ENVIRONMENTALLY FRIENDLY ELECTRIC GENERATION SYSTEMS.
WHEREAS,
the Indiana legislature has stated at I.C. § 8-1-2.4-1; " It is the policy of this state to encourage the development of alternate energy production facilities, cogeneration facilities, and small hydro facilities in order to conserve our finite and expensive energy resources and to provide for their most efficient utilization.
THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF PERU, INDIANA that the electric rate ordinance of the City of Peru be amended by adding to it the language contained in the proposed Electric Rate Tariff, which is Exhibit 1, attached hereto and made a part hereof.

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF PERU APPROVING THE REQUEST OF SNAVELY’S MACHINE & MANUFACTURING CO. INC. FOR TAX ABATEMENT

WHEREAS, Snavely’s Machine & Manufacturing Co. Inc. has applied for tax abatement benefits pursuant to I.C. 6-1.1-12.1-4.5, and

WHEREAS, Snavely’s Machine & Manufacturing Co. Inc. has filed a statement of benefits with the Miami County Auditor, a copy of which is attached hereto, and

WHEREAS, the estimated cost of manufacturing equipment will be $636,730.00, and the estimated cost of logistical distribution equipment will be $25,912.00.

WHEREAS, the Common Council has reviewed the statement of benefits and deems it advisable to approve and grant tax abatement status to Snavely’s Machine & Manufacturing Co. Inc. upon the following conditions:

1. The calculation of the deduction shall be in compliance with I.C. 6-1.1-12.1-4.5 (e).
2. The Company shall comply with the statement of benefits.
3. Failure to comply with the statement of benefits may be subject to I.C. 6-1.1-12.1-5.98; and
4. The City may recover past amounts abated in the event of noncompliance.

NOW THEREFORE BE IT RESOLVED that the Common Council of the City of Peru hereby approves Snavely’s Machine & Manufacturing Co. Inc. tax abatement for manufacturing equipment and logistical distribution equipment listed on the Statement of Benefits, which is hereby incorporated by reference, for a period of 5 years for manufacturing equipment and logistical distribution equipment upon the conditions set forth above.

A RESOLUTION DESIGNATING USBR #35
THRU THE CITY OF PERU, INDIANA

RESOLUTION of SUPPORT from CITY OF PERU, INDIANA for UNITED STATES BICYCLE ROUTE #35
Whereas: bicycle tourism is a growing industry in North America, contributing $47 billion a year to the economies of communities that provide facilities for such tourists, and
Whereas: the American Association of State Highway and Transportation Officials (AASHTO) has designated a corridor crossing the length of Indiana from Michigan to Kentucky, and vice versa, to be developed as United State Bike Route #35 (USBR #35), and
Whereas: the Hoosier Rails to Trails Council, Bicycle Indiana, with local communities and cyclists, and the Adventure Cycling Association, with the cooperation of the Indiana Department of Transportation and other stakeholders, have proposed a specific route to be designated as USBR #35, a map of which is herein incorporated into this resolution by reference, and
Whereas: the proposed route for USBR #35 comes through THE CITY OF PERU, INDIANA and can therefore provide a benefit to our residents and businesses, and
Whereas: we have investigated the proposed route and found it to be a suitable route, and desire that the route be designated so that it can be mapped and signed, thereby promoting bicycle tourism in our area,
Therefore, be it resolved that the CITY OF PERU, INDIANA, hereby expresses its approval and support for the development of USBR #35, and requests that the appropriate officials see to it that the signs within the CITY OF PERU, INDIANA identifying the route through the community once that official designation has been made.

ORDINANCE No. 29, 2011
AN ORDINANCE AMENDING ORDINANCE No. 2-1991,
PASSED FEBRUARY 4, 1991
WHEREAS, the Peru City Council previously adopted Ordinance No. 2-1991, establishing Construction Codes for the City of Peru; and,
WHEREAS, the Peru City Council believes it is in the best interest of the City of Peru to have Construction Codes as previously adopted; and,
WHEREAS, the International Property Maintenance Code 2006 was not previously adopted, the Peru City Council now amends the City of Peru Construction Codes to include the International Property Maintenance Code.
NOW THEREFORE, be it resolved by the City Council of the City of Peru, Indiana, that the International Property Maintenance Code, currently 2006 Edition, is hereby adopted and incorporated by reference, including any later amendments to that Code, as fully as if set forth herein, to govern existing buildings and structures in the City of Peru. At least two (2) copies of the 2006 Edition of the International Property Maintenance Code shall be kept at the City of Peru Code Enforcement Office, for public inspection.
NOW THEREFORE, this amendment shall be added to existing Code of Ordinances, under Section 152.07 as (1) (e) International Property Maintenance Code.
This Ordinance shall be in full force and effect beginning January 1, 2012, and shall be added to the Peru Code of Ordinances on the earliest revision date.

CITY OF PERU, INDIANA
ORDINANCE NO. 30-2011

WHEREAS, the City of Peru, Indiana ("City") is a member of Indiana Municipal Power Agency ("Agency"); and

WHEREAS, the Peru Utilities Service Board ("Board") is charged with the operation of the City’s electric utility ("Utility"); and

WHEREAS, the Agency and the City are authorized under IC 8-1-2.2-26 to make application and to enter into contracts for and to accept grants-in-aid from the federal government to maintain and operate any project or facility or to perform any function which the City or the Agency may be authorized by general or local law to provide or perform; and

WHEREAS, under IC 36-9-9-5, the City maintains and operates the municipal electrical lighting system, which includes municipal street lights; and

WHEREAS, the Indiana General Assembly allowed the Agency to be created under IC 8-1-2.2 to provide a method for certain municipalities to jointly finance, develop, own, manage, and operate generation and transmission facilities appropriate for the present and projected electric energy needs of such municipalities and to the changes in the electric utility industry affecting these municipalities or joint agencies; and

WHEREAS, the Common Council finds that there has been a change in the electric utility industry due to an increased importance placed at the federal level to employ energy efficient technologies to reduce the consumption of nonrenewable energy and carbon emissions; and

WHEREAS, the Common Council finds that the reduction of the nonrenewable energy consumption and carbon emissions will reduce the future demand on the Agency’s generation facilities and will allow the City to provide more economical electricity to its ratepayers by proactively implementing energy conservation measures; and

WHEREAS, the City is authorized under IC 8-1-2.2-10, to enter into contracts with the Agency to participate in projects with the Agency and to designate revenues of its electric system to such projects; and

WHEREAS, the Common Council is required to approve a contract for the replacement of the property of the electric utility by ordinance under IC 8-1.5-2-13; and
WHEREAS, the Agency received a federal grant through the Department of Energy’s Energy competitive Efficiency Conservation Block Grant program ("Grant") on behalf of its members that desire to participate in a streetlight retrofit program ("Retrofit Program") ("Participating Members"); and

WHEREAS, in order to be a Participating Member, the Agency requires the City or its municipal electric utility (1) commit a twenty-five percent (25%) match, comprised of ten percent (10%) in kind services of the electric utility employees to install the lighting and a fifteen percent (15%) monetary contribution from the electric utility revenues; (2) set aside fifty percent (50%) utility savings for a period of not less than five (5) years resulting from the Retrofit Program ("Savings") to be utilized for energy efficient public projects for public infrastructure and facilities within the electric utility service area for the Participating Member; and (3) provide energy savings information to the community and the Agency to help promote the merits on implementing energy efficiency measures and comply with federal reporting requirements; and
WHEREAS, the City must agree to enter into an agreement with the Agency in order to become a Participating Member, and the agreement will delineate the measurement of how the Savings will be calculated and other necessary requirements to participate in the grant program; and
WHEREAS, the City has determined that the cost to implement the City’s Retrofit Program will not exceed $76,410; and

WHEREAS, the Board has passed Board Resolution 6-2011 committing electric Utility funds to participate in the Retrofit Program;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF PERU, INDIANA THAT;

Section 1. The Common Council hereby approves the participation of the City in the Program as a Participating Member.

Section 2. The Common Council, based on a project cost for the Retrofit Program not to exceed $76,410, hereby approves matching funds to be committed by the Board, in the amount not to exceed $15,282, which is comprised of $6,112, an estimated value of in-kind services to install the Retrofit Program and $9,170 of electrical utility funds on hand.

Section 3. The Common Council hereby agrees that it will enter into a contract with the Agency and understands that the Board, through IMPA, will set-aside fifty percent (50%) utility savings resulting from the Retrofit Program to be utilized for energy efficient public projects for public infrastructure and facilities within the Utility’s service area for a period of not less than five (5) years.

Section 4. The Common Council, through the Board, hereby commits to provide energy savings information to the public and grant information to the Agency to help promote the merits on implementing energy efficiency measures and to comply with federal reporting requirements.

Section 5. The Common Council authorizes the Mayor and the Clerk-Treasurer to negotiate and execute a contract with the Agency consistent with the terms set forth in the ordinance without further approval from this Common Council.

Section 6. This ordinance shall be effective upon passage.
