REGULAR MEETING OF THE COMMON COUNCIL OF THE CITY OF PERU, INDIANA

July 7, 2008

The Common Council of the City of Peru, Indiana met in a regular session in City Hall at 6:00 p.m. July 7, 2008, with the following members present: Terry Alley, Steve Gough, Tom Gustin, Kurt Krauskopf, Cheryl Lee, Brian Robertson and Phyllis Torrence. Others present were Mayor James Walker, Clerk-Treasurer Jackquan E. Gray, Deputy Dea Masters, City Attorney Bruce Embrey, Department Heads and other interested persons.

Pledge of Allegiance was led by Councilman Terry Alley. Invocation was given by Pastor Rod Correll.

Kurt Krauskopf moved, seconded by Brian Robertson to suspend the rules and dispense with the reading and correcting of Journal of minutes of regular meeting on June 2, 2008.

COMMUNICATIONS:

Councilwoman Torrence gave a report on the Civic Center for the month of June 2008:

$575.69 was returned to the City 575 people used the center, 20 meals were served and 269 parties were held.

COMMUNICATIONS:

City Zoning & Building Department: Bill Gornto, Zoning Administrator, gave a report for June 2008:

16 complaints (trash, vehicles and misc.) 6 follow-ups., 14 grass complaints, 95 grass liens recorded, 4 grass liens released, 13 oversized vehicles parked on street, 18 permits issued, 3 garage demolitions issued.

Bill also gave an update on the dumpster issue and gave an update on the changes to the Ordinance Book.

NEW BUSINESS:

RESOLUTION NO. 9, 2008

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF PERU APPROVING THE REQUEST OF MODERN GRAPHICS, INC. FOR TAX ABATEMENT

WHEREAS, Modern Graphics, Inc. has applied for tax abatement benefits pursuant to I.C. 6-1.1-12.1-4.5, and

WHEREAS, Modern Graphics, Inc. has filed a statement of benefits with the Miami County Auditor, a copy of which is attached hereto, and

WHEREAS, the estimated cost of new manufacturing equipment will be $215,000.00

WHEREAS, the Common Council has reviewed the statement of benefits and find it is located in an economic revitalization area and deems it advisable to approve and grant tax abatement status to Modern Graphics, Inc. upon the following conditions:

        The calculation of the deduction shall be in compliance with I.C. 6-1.1-12.1-4.5 (e).

        The Company shall comply with the statement of benefits.

        Failure to comply with the statement of benefits may be subject to I.C. 6-1.1-12.1-5.98; and

        The City may recover past amounts abated in the event of noncompliance.

      NOW THEREFORE BE IT RESOLVED that the Common Council of the City of Peru hereby approves Modern Graphics, Inc. tax abatement for the equipment listed on the Statement of Benefits, which is hereby incorporated by reference, for a period of five (5) years upon the conditions set forth above.

       

       

      Kurt Krauskopf made a motion to leave Resolution 9, 2008 on the table until the August meeting, seconded by Brian Robertson.

NEW BUSINESS:

RESOLUTION NO. 10, 2008

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF PERU SUPPORTING THE COUNTY COUNCIL TO ADOPT A LOCAL OPTION INCOME TAX (COIT)

WHEREAS, the State of Indiana has adopted HB1001 which reduces the amount of property tax local government can raise to support the services a community requires; and

WHEREAS, the State of Indiana is recommending that local government adopt a Local Option Income Tax (LOIT) to support their budgets shortfalls; and

WHEREAS, the ability to establish a Local Option Income Tax (LOIT) to fund local government is the responsibility of the Miami County Council; and

WHEREAS, all the taxing units within the community will receive compensation from the Local Option Income Tax (LOIT) that is adopted by the County Council:

      NOW THEREFORE BE IT RESOLVED that the Common Council of the City of Peru does hereby offer their support to the Miami County Council in adopting a Local Option Income Tax (LOIT) to reduce the need for property tax dollars necessary to efficiently and effectively operate local government.

      Kurt Krauskopf made a motion to adopt, seconded by Phyllis Torrence.

NEW BUSINESS:

ORDINANCE NO. 13, 2008

AN ORDINANCE ESTABLISHING SALARIES AND WAGES OF THE CIVIL CITY EMPLOYEES AND APPOINTEES FOR THE YEAR 2008

Under the Acts of 1980, P. L. 212, Section 3, I. C. 36-4-7-3 (b) and (d) and Acts 1981,

P. L. 309, Section 52, I. C. 36-8-3-3 (d), it is provided, "that subject to the approval of the City Legislative Body, the City Executive shall fix the compensation of each appointive officer, deputy and other employees of the City. The Legislative Body may reduce but may not increase any compensation fixed by the Executive. When the salary of such officers or employees shall have been so fixed as herein provided, it shall be the duty of the Legislative Body to appropriate the monies to pay the same."

NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF PERU, INDIANA:

SECTION 1. That the following salaries and wages as set by the City Executive for each and all such appointive officers, employees, deputies, assistants and departmental and institutional heads, for the year beginning at 12:01 A. M., O'clock, January 1, 2009, are hereby approved subject to any federal wage orders, regulations or decisions.

FRINGE BENEFITS

ALL FULL TIME CITY EMPLOYEES:

1. Public Employees Retirement Fund - Employees pay 3% of wages, exclusive of Fire and Police Departments.

This participation amount will be deposited directly to each employee’s HSA.

Smokers/Tobacco Users means employee, spouse or dependent who smoke or use any smokeless tobacco products.

All employees/family members utilizing the health insurance program will be required to submit to a urine screening upon request by Peru Board of Public Works and Safety to test for nicotine. Testing will be conducted by Patient Care Partners. Failure to comply will be considered to be a nicotine user and will pay higher rate.

Anthem Blue Cross/Blue Shield Health Insurance will be based on a 2 tier system: Single and Family. The deductibles will be $2650.00/ Single and $5250.00/ Family.

The Group Health Insurance Program is Blue Access for a Health Savings Account (HSA). The Health Savings Account will be set up under each employee’s name. This account will be the sole responsibility of the employee.

The City of Peru will contribute $1,000.00/Single, $1,500.00/Employee and One Dependent and $2,000.00/Family to each employee’s HSA no later than January 15th, 2009.

Employees leaving the City of Peru employment will have to repay this amount at a rate of $83.00 a month/Single, $125.00 a month/ Employee and one Dependant and $167.00 a month/Family.

As per Resolution No. 2, 1992, members of the 1937 Fire Fighters Pension Fund and 1953 Police Officers Pension Fund who have completed 25 years of continuous service, the City of Peru shall pay 100% of the premium for said Public Safety Employee. However, in no event, shall the City of Peru be obligated to pay all or any portion of the premium for dependents, spouses, or surviving spouses. Unfortunately, due to extenuating circumstances, the City of Peru can no longer afford a self funded insurance plan. Therefore, we have been forced to change to a Health Saving Account for all employees and retirees. Consequently, the public safety employee will receive the same benefit as a single employee which will entitle that public safety employee to a deposit of $1,000.00 annually to their HSA no later than January 15, 2009.

3. City employees who use their personal vehicles for city business shall be compensated at the rate set per Federal Government.

4. Longevity Pay will be paid to each full time city employee including Firefighters and Police Officers as follows: After 1 year of service all employees to be paid ½ per cent per year of service based on employee’s base pay with increase payable each year on his/her anniversary date.

5. Overtime Pay for any hourly employee working in excess of eighty (80) hours per pay period shall be compensated at 150% of their normal hourly rate for each full hour exceeding eighty (80) hours. Police Department will also be compensated at 150% of their calculated hourly rate for each full hour exceeding eighty (80) hours.

6. All Sanitation, Motor Vehicle Highway and Traffic Department employees shall receive $300 per year Clothing Allowance; $150 to be paid on July 1st and $150 to be paid last pay in December. Employee must work 6 months before receiving full amount of Clothing Allowance benefit; less than 6 months to be pro-rated.

7. All Departments shall receive the same number of holidays as recognized on an annual basis by the Peru Board of Public Works and Safety. Each Firefighter/Police Officer will be paid $123.18 for each holiday; also, Clothing Allowance totaling

$ l, 000.00 per year.

8. All full time City employees, including Firemen and Policemen, will receive three (3) Personal Days, to be taken with the authorization of Supervisor.

9. Two (2) Police Officers will serve as follows: 1.) Supervisor of Car Maintenance; and

2.) Instructor of Firearms, and will receive compensation of $ 307.86 each per year, payable first regular payday in December.

10. The following Specialty Areas of pay for the Police Department are:

(6) ERT (Emergency Response/Entry Team)

(6) Certified Field Training Officers

(1) K-9 Handler

(1) Defensive Tactics Instructor

(1) School Resource Officer

Officer may elect additional compensation for not more than (2) Special Training Areas. Specialty Pay is payable to Officers upon successful completion and certification of each course of study. All Specialty Pay is $400.00 per individual. All specialty training must be pre-approved by the Board of Works.

11. All Full time employees will receive a $25,000.00 Life Insurance Benefit (this benefit is non-transferable.)

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF PERU APPROVING THE REQUEST OF MARS PROPERTIES, INC. FOR TAX ABATEMENT 

      WHEREAS, Mars Properties, Inc. has applied for tax abatement benefits pursuant to I.C. 6-1.1-12.1-4.1 and 

      WHEREAS, Mars Properties, Inc. has filed a statement of benefits with the Miami County Auditor, a copy of which is attached hereto, and 

      WHEREAS, the estimated cost of new green home construction will be $73,000.00 

      WHEREAS, the Common Council has reviewed the statement of benefits and find it is located in the Residentially Distressed Area and deems it is advisable to approve and grant tax abatement status to Mars Properties, Inc., upon the following conditions: 

          1. The calculation of the deduction shall be in compliance with I.C. 6-1.1-12.1-4.1

          2. The Company shall comply with the statement of benefits, submitted pursuant to I.C. 6-1.1-12.1-3

          3. Failure to comply with the statement of benefits may be subject to I.C. 6-1.1-12.1-5.98; and

          4. The City may recover past amounts abated in the event of noncompliance.

NOW THEREFORE BE IT RESOLVED that the Common Council of the City of Peru hereby approves Mars Properties, Inc. tax abatement for the real estate improvements listed on the Statement of Benefits, which is hereby incorporated by reference, for a period of five (5) years upon the conditions set forth above.
